Section 308(d) of the Public Health Service Act (42 U.S.C. 242m) is one of three confidentiality laws that apply to NCHS data related to this training.

 

Under the Public Health Service Act, NCHS must

  • Tell respondents how the information will be used and who will see their identifiable information
  • Limit use of information to the purposes for which it was collected
  • Not release identifiable information to anyone other than those whom respondents agreed may see it. If a promise of confidentiality is given, NCHS must protect confidentiality.

Moreover, the Public Health Service Act covers all NCHS systems.
