How does the Mediator decide who is right or who wins?

The Mediator/Neutral does not make decisions of this sort. In fact, the mediation process is not about winning and losing. The participants reach their own solution through discussion facilitated by the Mediator/Neutral. It is not like court or arbitration where a judge, Arbitrator or other third party imposes a decision or finding on the parties.

So, the parties should concentrate on persuading each other regarding the merits of their cases, not the Mediator. At the end of the day it does not matter what the Mediator/Neutral thinks, it matters only what each party has realized about their own and the other parties' cases, and then to what they may mutually agree in resolution of the issues and/or concerns.
