HHS Interim Final Rule and Notice of Proposed Rulemaking
The Department of Health and Human Services (HHS) has submitted an Interim Final Rule (IFR) and a Notice of Proposed Rulemaking (NPRM) regarding the procedural implementation of the James Zadroga 9/11 Health and Compensation Act of 2010 (Act) to the Office of Management and Budget (OMB) for their review.
The IFR supports the statutory requirements in the Act by establishing processes for enrollment, appeals, certification of health conditions, and reimbursement. Following review by OMB, the IFR will go into effect upon publication. The public will have the opportunity to comment at that time. HHS will carefully consider any comments and may revise the final rule as appropriate. Any revised final rule would be made publicly available. The NPRM supports the statutory requirements in the Act by establishing a process for the addition of new World Trade Center (WTC) related health conditions covered by the WTC Health Program. Upon publication following review by OMB, the public will have the opportunity to comment on the NPRM. HHS will carefully consider any comments and may make revisions before issuing a final rule.
