NIOSH Regulatory Agenda for updating 42 CFR Part 84
The National Institute for Occupational Safety and Health (NIOSH) is working to develop appropriate standards and test procedures for the various types of respiratory protective devices used to provide protection to workers in hazardous environments. NIOSH has initiated a program to update portions of Title 42 Code of Federal Regulations Part 84 (42 CFR Part 84) to promote improved performance and reliability of the various types of respiratory protective devices. NIOSH has defined a three year program to develop performance requirements for specific types of respirators and is seeking stakeholder feedback on what to include in its longer term regulatory agenda for updating 42 CFR Part 84.
This docket collects public comments related to items that NIOSH should consider in its regulatory agenda for updating 42 CFR Part 84. This subject will be discussed at a NIOSH sponsored public meeting that will be held on December 9, 2010 at the Hyatt Regency Pittsburgh International Airport. Information regarding the public meeting found here.
NIOSH is Seeking Comment from Stakeholders on the following:
- What classes of Respiratory protection should be addressed next in the regulatory agenda?
- What aspects of National and International Standards should be considered in updates to 42 CFR Part 84?
- Should NIOSH consider removing specific performance criteria from the regulation?
- Should NIOSH consider identifying sector specific performance capability assessments?
- Other perspectives?

Interested persons or organizations are invited to participate in this process by submitting written views, recommendations, and data. Written comments on the document will be accepted through March 31, 2011 in accordance with the instructions below. All material submitted to NIOSH should reference Docket Number NIOSH-221.
